<Purpose of the bill>

This bill seeks to amend the Road Traffic Act in order to establish stronger principles on prohibitions against stopping or parking a car in a child safety zone, to oblige drivers who caused an accident in a child safety zone to take additional special traffic safety education, and to make sure that safety workers or safety promotion facilities are deployed at road construction sites when they are needed.


<Highlights of the bill>

Article 32, subparagraph 8, newly inserted

Each driver of a motor vehicle shall be prohibited from stopping or parking a motor vehicle in any of the following places: Provided, That the same shall not apply in cases when the driver of a motor vehicle temporarily stops his or her motor vehicle to comply with this Act, any order issued under this Act, or instructions given by a police officer, and to prevent danger:

1 to 7. (same as now);
8. (newly inserted) A child safety zone that is designated by a city mayor, etc. in accordance with Article 12 (1) of this Act.


Article 34-2

Notwithstanding Subparagraph 7 or 8 of Article 32, or Subparagraph 3 of Article 33, motor vehicles may be stopped or parked in a place where stopping or parking of motor vehicles is prohibited under Subparagraph 7 or 8 of Article 32 or Subparagraph 3 of Article 33, if the commissioner of a district police agency permits stopping or parking in that place as an exception, with the permitted zones, time(s), stopping or parking methods, and kinds of motor vehicle specified on a safety sign.


Article 69 (4) and (5), newly inserted

(4) Throughout a construction work period, a work contractor under this Act shall deploy safety workers or road safety promotion equipment pursuant to the instructions of the chief of a relevant police station, if it is deemed necessary after taking into account the scale of the construction, traffic conditions in the vicinity, and other relevant factors.

(5) Matters necessary for the installation or deployment of traffic safety facilities, safety workers, or road safety notification equipment under the terms of Paragraph (3) and (4) shall be prescribed by relevant ordinance of the Ministry of Interior and Safety.


Article 73 (2), subparagraph 5

Any of the following persons shall receive mandatory special traffic safety education, as prescribed by relevant presidential decree. In such cases, he or she may be allowed to postpone such mandatory education, as prescribed by relevant presidential decree, if he or she falls under any of the Subparagraphs 2 through 5 and is in an unavoidable circumstance:

1 to 4. (same as now);

5. (newly inserted) Any person who received demerit points as per Article 93 (2) Within the past one year or less because he or she caused an accident while driving in a child safety zone as per Article 12 (1), thereby injuring or killing a child.


Article 154, subparagraph 7

Any of the following persons shall be punished by a fine not to exceed 300,000 won or by detention for less than 30 days:

1 to 6. (same as now);

7. (revised) Anyone who has failed to report on his or her road construction work as prescribed in Article 69 (1), has violated the measures provided for in Paragraph (2) of the same Article, has failed to install the traffic safety facilities provided for in Paragraph (3) of the same Article, has failed to deploy safety workers or road safety notification equipment in violation of Paragraph (4) of the same Article, or has failed to reinstate the traffic safety facilities in violation of Paragraph (6) of the same Article;

8. (same as now).
